Since being admitted as a solicitor in April 1982, Gary has been a strong advocate of resolving disputes through negotiation and conciliation without the need for a court hearing, which is both costly and emotionally draining.

  • During his 10 years as a solicitor, Gary was involved in numerous Family Law mediations either in the role as mediator, or in representing a client. The issues canvassed at the mediations involved both children or property, or a combination of both.
  • For the last five years of his time as a solicitor, Gary practised exclusively in the area of Family Law.
  • In 1992, Gary was admitted as a barrister of the Supreme Court of Queensland and of the High Court of Australia. Throughout his practice as a barrister, Gary has practised exclusively in Family Law. He has been briefed to appear in numerous children and property hearings, some of which involved very complex issues, but all of which were important. Gary frequently appeared in numerous trials and hearings in regional centres of Queensland and in interstate Family Courts and in Federal Circuit Courts.
  • Often, Gary was briefed to appear on behalf of the Independent Children’s Lawyer to represent the interests of Children.
  • Apart from conducting court hearings, Gary continued to chair mediations or represent clients at mediations.
  • Gary was elected to the executive committee of the Family Law Practitioners Association of Queensland and served a number of terms in this role.
  • Not only did Gary continue to attend lectures and courses to stay abreast of developments in Family Law, but Gary also presented many lectures and papers in this area of the law.
  • Gary undertook mediation courses and attended lectures on Alternative Dispute Resolution, primarily at Bond University. Through that university, he achieved his National Accreditation as a mediator.  Subsequently, Gary qualified as a Family Dispute Resolution Practitioner.
  • As more clients and practitioners embraced the practice of arbitration, Gary undertook training through the Australian Institute of Family Law Arbitrators and Mediators and achieved his registration as a Family Law Arbitrator.
  • In 2013, Gary ceased accepting instructions for court appearances. Since that time, he has continued chairing mediations and conducting arbitrations.

Gary is courteous and respectful to clients and participants in mediation, and has a thorough understanding and appreciation of the mediation process.  He is able to assist the parties to focus on the important issues and efficiently manages mediations.  As part of the mediation and arbitration process, Gary maintains an up-to-date knowledge of developments in Family Law.

When face to face mediations and arbitrations are not possible, Gary is able to conduct mediations and arbitrations using telephone or video conferencing facilities.

 

Services and Fees

Liability limited by a scheme approved under Professional Standards Legislation (2023)

Arbitration

  • First day of Arbitration
    $7,000 (Ex GST)

    This fee includes Preliminary Hearing and Preparation in the event that the arbitration proceeds on the date of the arbitration.

  • Additional Arbitration Days (per day)
    $3,500 (Ex GST)
  • Preliminary Arbitration Hearing (up to 3 hours)
    $1,500 (Ex GST)

    Conducting and reading letters of instruction and preparing arbitration agreement. NOTE: This fee is separately invoiced in the event that the arbitration does not proceed within 60 days of the allocated date due to no failure on the part of the arbitrator.

  • Preparation for Arbitration (up to 10 hours reading)
    $1,500 (Ex GST)

    NOTE: This fee is separately invoiced in the event that the arbitration does not proceed on the date of the arbitration due to no failure on the part of the arbitrator (eg where the matter settles, or the arbitration is cancelled).

  • Preparing & Drafting Arbitration Award (up to 10 hours)
    $3,500 (Ex GST)
  • Hourly Rate
    $400 (Ex GST)

    For items not covered by First day, Additional days, Preliminary hearing, and Preparation.

Mediation

  • Full Day Mediation (8 hours)
    $4,000 (Ex GST)

    Including travel, preliminary discussions with the lawyers and/or parties and reading the mediation brief (up to 1 hour reading)

  • Half Day Mediation (up to 4 hours)
    $3,000 (Ex GST)

    Including travel, preliminary discussions with the lawyers and/or parties and reading the mediation brief (up to 1 hour reading)

  • Hourly Rate
    $400 (Ex GST)

    For items not covered by Full Day, Half Day and Extension.

Mediation more than 1 day
If the mediation extends, the same arrangements apply in respect of fees and expenses.
